2. Scope of these Terms<\/h2>

These Terms and Conditions apply to purchases made in the online shop available through www.bombay.hu. By placing an order, the Customer accepts these Terms.<\/p>

The language of the contract is Hungarian. The contract concluded does not qualify as a written contract; it is not filed by the Service Provider and is not accessible afterwards.<\/p>

3. The product available for purchase: electronic gift voucher<\/h2>

Only electronic gift vouchers redeemable at the Bombay Budapest restaurant can be purchased in the online shop, in the following values: 10 000 Ft, 20 000 Ft, 50 000 Ft.<\/p>

Prices are in Hungarian forints and include value added tax. The gift voucher is not a product but a payment instrument of a fixed value issued by the Service Provider, redeemable at the Service Provider's restaurant. The voucher is used once, for its full value; partial redemption is not possible.<\/p>

4. The ordering process<\/h2>
  1. The Customer selects the value and the quantity, and adds them to the basket.<\/li>
  2. At the checkout the Customer provides their billing details and the email address to which the voucher should be sent.<\/li>
  3. The Customer accepts these Terms and the privacy policy.<\/li>
  4. The Customer selects a payment method and completes the payment.<\/li>
  5. The Customer receives an automatic confirmation email about the successful payment and the order.<\/li><\/ol>

    The Service Provider confirms the order within 48 hours of receipt. If the confirmation does not arrive within this period, the Customer is released from the obligation to maintain the offer.<\/p>

    In the event of a data entry error, the Customer may correct their details on the basket page before submitting the order. Any error noticed after submission may be reported at araashoffice@bombay.hu.<\/p>

    5. Payment<\/h2>

    Payment is made online by bank card through the SimplePay system. Accepted card types: Visa, Mastercard, Maestro.<\/p>

    The Customer acknowledges that the personal data stored about them in the user database of www.bombay.hu by the Service Provider as data controller will be transferred to OTP Mobil Kft. (1143 Budapest, Hung\u00e1ria krt. 17-19.) as data processor. The data transferred: name, email address, billing address, order details. The purpose of the transfer: carrying out the payment and confirming transactions, protecting users, and preventing fraud.<\/p>

    6. Invoicing<\/h2>

    Following payment, the Service Provider issues an electronic invoice and sends it to the email address given by the Customer. By placing the order, the Customer consents to the issuing of an electronic invoice.<\/p>

    7. Delivery of the voucher<\/h2>

    After successful payment, the electronic gift voucher is delivered automatically by email in PDF format, with a unique identifier code and a QR code. Delivery usually takes place within a few minutes.<\/p>

    If the voucher does not arrive within 24 hours, the Customer may request that it be sent again at araashoffice@bombay.hu, having first checked the spam folder.<\/p>

    8. Using the voucher<\/h2>
    • The voucher can be redeemed at the Bombay Budapest restaurant (1051 Budapest, Okt\u00f3ber 6. utca 17.), against the full food and drinks menu.<\/li>
    • Validity: 12 months from the date of purchase. The expiry date is shown on the voucher.<\/li>
    • Redemption takes place at the time of payment, by presenting the code or the QR code of the voucher. We accept it both printed and displayed on a screen.<\/li>
    • The voucher is used once, for its full value.<\/strong> Partial redemption is not possible. If the final total of the bill is lower than the value of the voucher, the difference is not returned and cannot be used later.<\/li>
    • More than one voucher may be used against a single bill.<\/li>
    • The value of the voucher may also be applied to the service charge.<\/li>
    • If the final total of the bill exceeds the value of the voucher, the difference is paid by the guest on the spot.<\/li>
    • The voucher cannot be exchanged for cash, and no cash change is given from it.<\/li>
    • The voucher may be passed on to someone else.<\/li>
    • The Service Provider accepts no liability for a voucher that is lost or used by an unauthorised person. The voucher code should therefore be kept confidential.<\/li>
    • An expired voucher cannot be redeemed, its value is not refunded, and the validity period cannot be extended.<\/li><\/ul>

      9. Right of withdrawal<\/h2>

      Under Government Decree 45\/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, a Customer qualifying as a consumer may withdraw from the contract without giving reasons within 14 days of its conclusion.<\/p>

      The right of withdrawal may be exercised for as long as the gift voucher has not been used. If the voucher has been used, in whole or in part, the right of withdrawal cannot be exercised, not even for the unused value.<\/p>

      The intention to withdraw must be communicated by an unambiguous statement, sent by email to araashoffice@bombay.hu. The Service Provider refunds the amount paid within 14 days of receiving the withdrawal, using the same payment method the Customer used.<\/p>

      10. Complaints and remedies<\/h2>

      The Customer may submit a complaint at araashoffice@bombay.hu or on +36 20 413 0484. The Service Provider gives a substantive reply to written complaints within 30 days.<\/p>

      If handling the complaint does not lead to a resolution, the Customer may turn to the following bodies:<\/p>

      • Consumer protection authority:<\/strong> the consumer protection department of the government office competent for the place of residence.<\/li>
      • Conciliation board:<\/strong> Budapest Conciliation Board, 1016 Budapest, Krisztina krt. 99. 3rd floor 310. Postal address: 1253 Budapest, Pf. 10.<\/li>
      • Court:<\/strong> the Customer may also enforce their claim through the courts.<\/li><\/ul>

        The Service Provider has an obligation to cooperate in conciliation board proceedings.<\/p>

        11. Other provisions<\/h2>

        The Service Provider is entitled to amend these Terms unilaterally. An amendment enters into force upon publication on the website and does not affect orders already placed.<\/p>

        The content of the website is protected by copyright. Copying or using the content without the prior written permission of the Service Provider is prohibited.<\/p>
